Question: Difference between owning a moped and an electric scooter in Manhattan?

According to the DMV, an electric scooter is illegal to ride in Manhattan, while a Moped is legal.

What is the difference between an electric scooter with a seat and a moped? If want to buy something like this, how do I know whether I am buying an “electric scooter” (illegal) or a “moped” (legal)?
